McDonald's Restaurants of Ireland, a company limited by shares, registered in Ireland under number 127316, having its registered office at 7 Richview Office Park, Clonskeagh, Dublin 14, ("McDonald's") has established this site (the "Site") for your personal entertainment, information and communication. The Site is subject to the following terms and conditions ("Terms and Conditions"). By accessing the Site, you accept these Terms and Conditions.
Terms and Conditions
You may, subject to paragraph 8, download one copy of the materials contained in or displayed on the Site and print off pages of the Site for non-commercial personal use only provided that:
(a) no documents or related graphics on the Site are modified in any way;
(b) you do not remove or alter any copyright and other proprietary notices contained on the materials; and
(c) all use is for lawful purposes only.
Neither the content of the Site nor any part of it may be distributed, reproduced, modified, transmitted, reused, re-posted or used for public or commercial purposes without McDonald's prior written permission.
If you breach any part of the terms of this notice, your permission to use the Site automatically terminates and you must immediately destroy any downloaded or printed extracts from the Site.
If you download any software from the Site, the software, including all files, images, contained in or generated by the software and accompanying data (together, the "Software") are deemed to be licensed to you by McDonald's. Neither title nor any intellectual property rights are transferred to you, but remain with McDonald's. You may not resell, decompile, reverse engineer, disassemble or otherwise convert the Software to a human perceivable form. Either party may terminate the licence at any time immediately with or without notice and on such termination you must destroy all materials including (but not limited to) the Software obtained from the Site and all copies.
The Site and the content, functionality and design of the Site is protected in the Republic of Ireland and elsewhere in the World by copyrights trade marks, designs and/or design rights and other intellectual property rights or either used by McDonald’s under licence from a third party or owned by McDonald's or a member of the McDonald's Family; this means McDonald's Corporation and each of its subsidiaries, together with their respective franchisees and certain selected companies (which are either partners who perform a function such as prize-provision within promotions and offers, or agencies and suppliers whom McDonald’s have retained to assist in more effectively fulfilling orders, managing and conducting promotions and offers, providing technical assistance and support and performing other functions to support McDonald’s marketing activities).
None of the Site, the Site content, the Site functionality or the Site design, nor any part of any of each, may be used in any manner whatsoever, except either as provided for in these Terms and Conditions or in the text on the Site or within the strict terms of the written permission of McDonald's obtained for the proposed use in advance of such use (and in respect of which. McDonald's neither warrants nor represents that your proposed use will not infringe any third party rights).
The materials contained in or displayed on this Site are provided "as is" and without warranties or representations of any kind either expressed or implied. McDonald's disclaims all warranties of satisfactory quality and fitness for a particular purpose. McDonald's does not warrant that the functions contained in the materials will be uninterrupted or error-free.
McDonald’s, any other party (whether or not involved in creating, producing, maintaining or delivering the Site), and any of the McDonald’s Family and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the Site in any way or in connection with the use, inability to use or the results of use of the Site, any websites linked to the Site or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Site or your downloading of any material from the Site or any websites linked to the Site. Nothing in this legal notice shall exclude or limit McDonald's liability for:
(a) death or personal injury caused by negligence; or
(b) fraud; or
(c) misrepresentation as to a fundamental matter; or
(d) any liability which cannot be excluded or limited under Irish law.
If your use of material on the Site results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.
Save for information covered by the McDonald’s Restaurants of Ireland Ltd Internet Privacy Statement (“ McDonald’s Privacy Statement”), any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, ideas, graphics or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post shall subject to the McDonald’s Privacy Statement, become the exclusive property of and may be used by McDonald's or other members of the McDonald's Family or on behalf of either at any time and for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, McDonald's is free to use any ideas, concepts, know-how or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information.
You are prohibited from posting or transmitting to or from the Site any material:
(a) that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; or
(b) for which you have not obtained all necessary licences and/or approvals; or
(c) which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or
(d) which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).
You may not misuse the Site (including, without limitation, by hacking). McDonald’s shall fully co-operate with any law enforcement authorities or court order requesting or directing McDonald’s to disclose the identity or locate anyone posting any material in breach of the above.
The trade marks and logos (the "Trade Marks") displayed on Site include the registered and unregistered trade marks of the McDonald's Family and of other businesses. Nothing in these Terms and Conditions on the Site may be construed as granting any licence or right to use any of the Trade Marks without the prior written permission of McDonald's or other proprietor of the Trade Marks. Any use of the Trade Marks or any other content on the Site except as provided in these Terms and Conditions is strictly prohibited.
McDonald's has not reviewed any sites linked to the Site and is not responsible for and does not endorse the content of any off-site pages or any other sites linked to the Site. Your linking to any other off-site pages or other sites is entirely at your own risk.
While McDonald’s endeavours to ensure that the Site is normally available 24 hours a day, McDonald’s shall not be liable if for any reason the Site is unavailable at any time or for any period. Access to the Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond McDonald's control.
Unless otherwise stated or the context requires otherwise the Site relates to the business of McDonald's in the Republic of Ireland only.

Any exclusion or restriction of liability contained in these Terms and Conditions shall apply only to the fullest extent permitted by the laws of the Republic of Ireland.

To the extent that this Site or any activity contemplated by it would infringe any law of a jurisdiction other than the Republic of Ireland, then you are prohibited from accessing this Site or attempting to carry on any such offending activity and this provision shall override all other provisions of these Terms and Conditions.
Any use of the Site shall be subject to the laws of the Republic of Ireland and any dispute arising from such use or otherwise in connection with the Site shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
